The terms beneath the conversation.

These are the terms on which you can use the Ardenna website and engage with us. Plain English first; binding agreements for customer deployments are negotiated separately.

Ardenna is a product of Aeth8er (ABN 11 662 898 642). These terms cover the public-facing Ardenna site and general enquiries. If you are a customer running Ardenna in your own environment, your use is governed by your Master Services Agreement with us — not by this page.

About these terms

These terms govern your use of the Ardenna website at https://ardenna.app and any related public-facing services we make available to visitors. By using the site you agree to these terms.

Ardenna is operated by Aeth8er (ABN 11 662 898 642). Customer use of the Ardenna product is governed by a separate Master Services Agreement and Data Processing Addendum entered into between Aeth8er and the customer; if you are a customer, that agreement prevails over these terms to the extent of any conflict.

Who can use the site

You may use the site if you are at least 18 years old and able to enter into a binding contract under applicable law. If you use the site on behalf of an organisation, you confirm that you have authority to bind that organisation to these terms.

Acceptable use

When using the site, you agree not to:

  • use it for any unlawful purpose, or in a way that infringes the rights of others
  • attempt to access, probe, or test the security of the site or its underlying systems without our prior written consent
  • reverse-engineer, scrape, or systematically extract content from the site, except as expressly permitted
  • interfere with the operation of the site (for example, by introducing malware or running denial-of-service traffic against it)
  • misrepresent your identity, your organisation, or your relationship with us

We may suspend or restrict your access if we reasonably believe you are using the site in breach of these terms or in a way that risks harm to us or other users.

Content on the site

The site contains information about Ardenna, our products, and the way we think about software for complex organisations. We work to make this information accurate and up to date, but the site is provided for general information only — it is not advice, and we do not warrant that any particular outcome will follow from using our products.

Specifications, capabilities, and timelines described on the site may change. Anything that is binding will be set out in a written agreement between you and us.

Intellectual property

The site and its contents — including text, graphics, logos, illustrations, and the Ardenna name and brand — are owned by Aeth8er or its licensors and are protected by copyright and other intellectual-property laws. You may view and print pages of the site for your own internal, non-commercial reference.

No other licence is granted. In particular, you may not republish, redistribute, or otherwise commercially exploit any of the content without our prior written consent.

Submissions and feedback

If you send us feedback, ideas, or suggestions about the site or our products, you grant us a perpetual, worldwide, royalty-free licence to use that feedback to operate and improve our products. You confirm that any feedback you provide is not confidential and does not include personal information of anyone other than yourself unless you have authority to share it.

Third-party links and services

The site may link to third-party sites and services. We provide those links for convenience; we are not responsible for the content, availability, or practices of any third-party site or service, and the inclusion of a link is not an endorsement.

Privacy

Our handling of personal information collected through the site is described in our Privacy Policy. By using the site you acknowledge that you have read it.

Disclaimer

The site is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we exclude all warranties, conditions, and representations of any kind — express, implied, or statutory — in relation to the site, including warranties of merchantability, fitness for a particular purpose, accuracy, completeness, and non-infringement.

Nothing in these terms excludes, restricts, or modifies any consumer guarantees or other rights you have under the Australian Consumer Law (or equivalent local law) that cannot lawfully be excluded.

Limitation of liability

To the maximum extent permitted by law, Aeth8er is not liable for any indirect, special, incidental, consequential, or punitive loss or damage arising out of or in connection with your use of the site, even if we have been advised of the possibility of such loss or damage.

Where our liability cannot lawfully be excluded but can be limited, our total aggregate liability to you arising out of or in connection with the site is limited, at our option, to re-supplying the relevant service or paying the cost of having the relevant service re-supplied.

Changes to these terms

We may update these terms from time to time. The effective date at the top of the page reflects the most recent change. If you continue to use the site after the effective date of any change, you accept the updated terms.

Governing law

These terms are governed by the laws in force in Queensland, Australia. You and we each submit to the non-exclusive jurisdiction of the courts of Queensland in respect of any matter arising out of or in connection with these terms.
